Disclaimer

This page sets out what this website is and what it is not. In short: we are a marketing agency, not a healthcare provider, nothing here is medical advice, and we do not guarantee marketing results. The detail is below.

Who we are

The Healthcare Marketing, also written as THM, is a digital marketing agency working with healthcare businesses. In this disclaimer, "we", "us" and "our" mean The Healthcare Marketing (THM), and "you" means anyone reading this website or working with us.

We operate online from the United States and work with clients there and in the United Kingdom, Canada and Australia.

What this disclaimer covers

This page sets out the limits of what this website is, and what our work does and does not promise. It applies to every page here, including service pages, articles, guides, case studies, examples and anything we publish elsewhere under our name.

It sits alongside our terms and conditions and privacy policy. Where your signed proposal or agreement with us says something more specific, that document applies.

This is not medical advice

This is the most important thing on the page, so it is first.

We are a marketing agency. We are not doctors, dentists, nurses, pharmacists or clinicians of any kind, and we do not provide healthcare. Nothing on this website is medical advice, a diagnosis, a treatment recommendation or clinical guidance, and nothing here should be used to make a decision about anyone's health.

If you are a patient who has arrived here by accident, please speak to a qualified healthcare professional about your health. In an emergency, contact your local emergency service rather than reading anything further on this site.

Where we write about treatments, conditions or procedures in marketing content, we are describing how patients search for and choose care, not advising on the care itself. Clinical accuracy in anything we write for a client is confirmed by that client's clinicians before it is published, and it remains their responsibility.

This is not legal, regulatory or financial advice

We write about healthcare advertising rules, platform policies, privacy practice and the commercial side of running a practice. That is general guidance drawn from working in the sector. It is not legal advice, not regulatory advice and not financial advice.

The rules that apply to you depend on your country, your state or province, your profession and your regulator, and they change. What is permitted for one practice in one market is sometimes prohibited for another a border away. Before acting on anything you read here, check it against the rules that apply to you and take professional advice where the decision warrants it.

We also do not hold ourselves out as a compliance service. Where compliance matters to a project, we work within the limits your compliance or legal team sets rather than replacing them.

We do not guarantee results

Written plainly because it matters more than its length suggests.

We do not guarantee a position in search results, a volume of traffic, a number of enquiries, a number of patients, a cost per enquiry, a conversion rate or a return on your spend. Nobody who is being straight with you will.

Marketing results depend on things nobody controls: your market and competitors, your pricing, your availability, how quickly enquiries are answered, your reputation offline, seasonality, and the search and advertising platforms themselves, which change their rules and their results without notice.

What we commit to is telling you what we would do and why, forecasting from real data where real data exists, reporting honestly on what happens, and saying so when something is not working.

Case studies, examples and figures

Any figures, examples or case studies we publish describe what happened for a particular client, in their market, at a particular time, with the budget and conditions that applied then.

They are a record, not a prediction, and they are not a promise that your project will produce anything similar. Two practices running the same work in different cities routinely get different outcomes.

Where we show numbers, they come from the reporting behind that project. Where we cannot evidence a figure, we do not publish one.

Client work shown on this site

Projects shown in our portfolio and case studies are published with the relevant client's agreement, and we describe the kind of organisation rather than naming brands where a client prefers that.

Those sites are live and under their owners' control. They change, and they may have been edited, extended or rebuilt by others after our involvement ended, so what you see today may not reflect the work we delivered. Linking to a project is not an endorsement of anything currently published on it, and the organisations shown do not endorse us by appearing here.

No patient information appears in any example we publish.

What stays your responsibility

When we produce marketing for a healthcare business, the business remains responsible for what it publishes. Specifically:

  • Clinical accuracy. Anything clinical is reviewed and approved by your clinicians before it goes live.
  • Claims you can support. Treatment claims, outcome claims and comparative claims have to be defensible under the rules that apply to you.
  • Professional and regulatory obligations. Your registration body's advertising rules apply to your marketing, whoever produced it.
  • Patient consent. Photographs, stories and testimonials involving identifiable patients need consent before publication. Obtaining it is yours.
  • Accuracy of what you give us. Credentials, qualifications, services, locations and prices are published as you supply them.

We will raise concerns when we see them, and we will decline to write something we believe is not supportable. That is not the same as approving what is published.

Accuracy and currency

We take care with what we publish, but digital marketing moves quickly. Platform rules, best practice and the tactics that work change, sometimes within weeks, and an article written in good faith can be out of date without being withdrawn.

We do not warrant that everything here is complete, current or free of error, and we are not obliged to update older content. Where something is time-sensitive, check the current position before relying on it.

Liability

Nothing here limits liability where the law does not allow it to be limited, including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for loss arising from reliance on information published on this website. Liability in connection with work we are engaged to deliver is dealt with in our terms and conditions.
